Data protection laws have changed in the European Union. To comply with the new laws, we have updated our Terms of Service to reflect the new requirements. We encourage you to review them. If you have questions about GDPR or the changes to our terms of service, please contact our support team.

Introduction

Please read these terms of use and privacy policy carefully. This is a legal agreement. By signing up for an account with the About my Brain Institute, using and/or purchasing our products and services, you are agreeing to these terms.

The About my Brain Institute Pty. Ltd. and AMBi Digital Pty. Ltd. (www.aboutmybrain.com) will be referred as the “About my Brain Institute”, “we” or “us” from now on.

The About my Brain Institute is comprised of directors, independent contractors and representatives who will henceforth be referred to as our “Team”. The services we provide either online, over the telephone, as print out, via mail or in-person, shall be referred to as ‘services'.

As a customer for the services we provide, we will refer to you as either “Member” or “you”.

These terms of use define the relationship between the About my Brain Institute and the member whilst your account remains active with us. If you have any questions about our terms contact us.

Signing up for an account

1. Eligibility

In order to use the About my Brain Institute services, you must:

  • Be at least eighteen (18) years old and legally able to enter into contracts;
  • Complete the registration process;
  • By registering for an account, we assume you have read and agreed to the Terms stipulated on this page; and
  • Provide true, complete, and up to date contact information.

By using our services, you represent and warrant that you meet all the requirements listed above, and agree that you won't use About my Brain Institute's services and/or products in a way that violates any laws or regulations.

About my Brain Institute may refuse service, close accounts of any users, and change eligibility requirements at any time. Representing and warranting is like making a legally enforceable promise.

2. Term

The term begins when you sign up for About my Brain Institute and continues as long as you use our Service. Registering your first name, last name and email and clicking on the 'create an account' button means that you've officially “signed” the terms.

If you sign up for About my Brain Institute on behalf of a company or other entity, you represent and warrant that you have the authority to accept these Terms on their behalf.

It is your responsibility to ensure that the personal information for yourself and your raters you provide to us is accurate, complete and up-to-date. You may request access to the information we hold about you, or request that we update or correct any personal information we hold about you, by setting out your request in writing to: support@aboutmybrain.com

3. Closing Your Account

You or About my Brain Institute may terminate this Agreement at any time and for any reason, by giving notice to the other party. We may suspend our services at any time, with or without cause. Once terminated, we may permanently delete your account and all the data associated with it, including your emails from our website. If you do not log in to your account for 12 or more months, we may deem your account to be "inactive". Consequently, we may permanently delete your account and all of its associated data.

It is your right to request that your account be deleted, should you wish to do so, please contact us at: support@aboutmybrain.com we will endeavor to complete your request without delay.

On termination, your personal identifiable information will be removed, which includes but not limited to first name, last name, email, password, IP address, activity time stamp and device user agent. For archiving purposes and in the public interest, data derived by using our intellectual property will be retained. This includes; scientific, historical research or statistical information, e.g. the i4 Neuroleader Assessment benchmarking data and rater results. This information will be retained as anonymous, please note that this data cannot be used to reverse engineer or look up any individual or device.

4. Acceptable Use Policy

Our Acceptable Use Policy sets out some rules that you have to follow as an About my Brain Institute user. Some are dictated by the law, some are common sense (do unto others), and some are based on our experience.

5. Changes

We may change any of the terms by posting revised Terms of Use on our Website and/or by sending an email to the last email address you provided to us. Unless you terminate your account within ten (10) days, the new Terms will be effective immediately and apply to any continued or new use of About my Brain Institute services and products. We may change the website, the service, or any features of the service at any time, with or without cause.

6. Account and Password

You are responsible for keeping your account name and password confidential. You are also responsible for any account that you have access to, whether or not you authorised the use of it. You will notify us immediately of any unauthorised use of your personal account, or accounts you are permitted to access. We are not responsible for any losses due to stolen or hacked passwords. We do not have access to your current password, and for security reasons, we may only reset your password.

7. Account Disputes

About my Brain Institute does not arbitrate disputes over who owns an account. Only the account owner can request access to, or information about an account. About my Brain Institute will decide who owns an account based on the content of the emails or information in that account, and if multiple people or entities are identified in the content, then About my Brain Institute will rely on the contact information listed in the account.

8. Assessment Disclaimer

About my Brain Institute is not responsible for any assessment results, the outcome of any debrief sessions or any actions a person may or may not decide to conduct during and/or after receiving their report. The assessment report contains sensitive, private and confidential information.

Doing assessments and/or receiving feedback is a common leadership practice that may assist individuals in developing as leaders. At no point do we advocate that these results are used for any purpose other than development.

It is the sole responsibility of individuals to seek professional advice about any matter affecting them. No person should act, or fail to act, on the basis of any material contained in the questionnaire/s or report/s.

No advice or information obtained from any of the aforementioned, whether written or oral, shall create any warranty unless otherwise expressly stated. The assessment and report are based on sound leadership practice theory, research and validation; however, About my Brain Institute makes no warranties, legal or otherwise, regarding the accuracy or reliability of the same.

To the maximum extent permitted by law, you assume full responsibility for any loss that results from your use of the website and the services, including any downloads from the website.

9. Confidentiality

9.1. Participants
Your Dashboard account is confidential, and only you are able to access it. You can, however, provide written consent to the administrator of About my Brain Institute, if you want us to solve any issues regarding your account.

In the case of the 360° Feedback Assessment, the assigned Practitioner will have access to your report prior to you viewing the results, when a Practitioner is engaged to that effect.

When you sign up to participate in the 360° Feedback Assessment, you are giving your permission for one of our Practitioners to view your results for the purpose of debriefing and coaching. All of our Practitioners are experienced professionals, and have signed confidentiality agreements to ensure your privacy is protected.

You are not obliged to share the results of your assessment report with anyone else in your organisation, unless you decide to do so. Neither the Human Resources department, nor your manager, will ever receive a copy of your results unless you provide written permission for us to do so. If your organisation runs the project in-house, the assigned internal Practitioner should be the only person with access to your results.

At the conclusion of any of the questionnaires you complete, your data automatically becomes the property of About my Brain Institute, and is integrated into our database which builds the infographic display that is featured on the dashboard. Your name and any personal identifiable information always remain anonymous.

9.2. Raters
All raters are required to create an account in order to rate the person who invited them. The assessment, reports and rater participation has been designed to be protected by a password system, purely to help maintain the privacy for all parties (the participant and the raters) as well as to offer identifiable technical support by the About my Brain Institute when needed.

The unique rater assessment link token invitation should not be shared or made public, and it is only to be completed by the intended rater who was originally invited by the participant.

Once raters create an account, they are able to manage multiple assessment invitations by logging into their dashboard. Only a name, email and password of their choice is required by the raters and no other personal information is requested as part of the i4 Neuroleader Assessment rating process.

If a rater wishes to delete his/her account after completing the rating process, please email us at: support@aboutmybrain.com.

Raters will not be subscribed to any marketing emails unless they choose to subscribe via our website, or by ticking the subscribe button when creating an account. AMBi will not contact raters directly for any other reason other than to respond to any support requests that are initiated by the rater.

The only emails that raters will receive from AMBi are from our Dashboard System https://login.aboutmybrain.com.

Please note that these invitations are only sent by someone you may know so that you can rate them in the i4 Neuroleader Assessment process - and are not unsolicited emails. They are triggered in our system by an individual you may know and we send these emails on behalf of the initiator.

10. Copyright

About my Brain Institute owns the copyright of this website and its content. All rights are reserved. No part of this content may be reproduced or transmitted in any form or by any means (including electronic) without prior written permission from About my Brain Institute. Unless you are the owner of an account, please do not read, save, print, disclose or copy any of its contents.

All items included in the questionnaire/s are copyright of About my Brain Institute are not available for revision, distribution or duplication at any time.

11. Privacy Policy

The About my Brain Institute is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. Our systems are designed with security and privacy in mind that all user information is protected with strong passwords.

All user account passwords are encrypted with algorithms for security, these systems have not failed before. Only relevant stakeholders (developers and system administrators) will have just enough/adequate access to your information. This Statement applies to the About my Brain Institute website and authorised i4 Partners, Practitioners & Trainers that governs data collection and usage. By using the About my Brain Institute website, you consent to the data practices described in this statement.

11.1. Collection of your Personal Information
The About my Brain Institute collects personally identifiable information, such as but not limited to, email addresses, names, home or work addresses and/or telephone numbers. When obtaining this information it is your right to know who will have access to this data and to request access in digital PDF form of this data.

If obtaining personal data such as but not limited to postal codes, age, gender and/or preferences, these will all be anonymous.

The About my Brain Institute will not collect personal data about, but not limited to, race or ethnic origin, political opinions, religious or philosophical beliefs, processing of genetic data, data concerning health or data concerning a natural person’s sex life or sexual orientation, without express and explicit consent.

Please keep in mind that if you directly disclose your own personal identifiable information or personal sensitive data through About my Brain Institute's social media channels, this information may be collected and used by those third parties.

11.2. Use of your Personal Information

Registering an account with us: The basic information of first name, last name, email and password are used to create an account for the purpose of consuming our free-member-only content. This also forms the foundation for you to consume our other content at a later date and if you wish to move forward with the services of the About my Brain Institute.

Making purchases: Information such as billing, shipping and payment information are collected in order to complete the transaction successfully as well as to fulfil our services to you after purchase (such as delivery of any physical products). For information specifically on handling payment information, please refer to our “Credit Cards” section (14) of this document.

Completing the i4 Assessment: When participants complete the Self or 360 Assessment, we will collect additional demographic information. The intended use of this data is only for scientific, historical research and statistical purposes only, with the aim of producing a global benchmarking graph for our i4 Report. The following information collected is aggregated with benchmarking groups and shown anonymously. Furthermore your personal identifiable data is never published together with the following data that is collected:

  • Gender
  • Generation (year of birth)
  • Language
  • Country and city of residence
  • Country and city of birth
  • Industry
  • Profession
  • Position

Please note that raters are not asked this infortmation. These details are used for research purposes as well as to fulfil the requirement to deliver our products. Before this data is used in our benchmark reporting, all personal identifiable information is stripped out.

Rater Review: The review, as part of the assessment process, to be completed by raters, as stated in the “Raters” section (9.2), are nominated by the participant and as such we do not have full control of who will or will not receive the invitation. As part of the invitation, raters’ email and their relationship with the participant are provided by the participant. This information is solely used for the review and relevant report generation purpose and is the integral part of our service to our users. About my Brain Institute does NOT use any of this information for other services or to obtain any benefits from storing them, and as such remove all personal identifiable information from responses, the data is keept anonymous at completion of the review.

11.3. Collection of data for our authorised i4 Partners
The About my Brain Institute has global authorised i4 Partners that deliver our services in different regions. These i4 Partners have co-branded landing pages that you may use to download a content offer, purchase a product or enroll in a course.

Your data in this case will be collected by the About my Brain Institute and shared with the authorised i4 Partner that appears on the landing page. By submitting your information on these landing pages you are agreeing to receive email communications from the About my Brain Institute and the i4 Partner.

11.4. Handling, retaining and processing of your Personal Information
The About my Brain Institute uses external services to store, and process your personal information. These third party service providers are chosen based on the fact that their privacy policies align with us and the GDPR. Their operations are subject to at least the same level, if not higher levels, of law on how your personal information is used.

Strictly only the information required to use our service is given. Service providers that may have access to any personal data are included further down, as stated these are only used for specific requirements, as part of our system, and as such only have limited access. For full accountability, understanding and protection we suggest you have a read of their privacy terms:

Your information will be stored indefinitely but any direct personal identifiable information is open for you to change at your own will. The majority of user information is stored in our data center located in Singapore.

11.5. Obtaining Your Information
It is your right to obtain any personal identifiable information you have provided to us in a easily structured and machine readable format, most likely as a PDF. For access to this please contact us via: support@aboutmybrain.com

11.7 Data Breach
In the case of a data breach we will endeavor to notify all individuals via email, announcements on our main site, and through social media as soon as feasibly possible. Within this contact we will notify affected individuals of the issue and the severity of the incidence. Within 72 hours of detection of the breach we will contact the correct authorities and whenever the solution, contingency plan, mitigation plan or fixes are known, we will also make the appropriate announcements.

If the breach only obtains to a few individuals we will only contact those affected individuals as well as contacting the correct authorities. We will always endeavor to protect your personal information and never post on social media any information that may have been breached.

12. Email Communications

There are 2 types of email notifications that you may recevie from us. These are explained below:

System Emails:
The first type of email is from the Dashboard System https://login.aboutmybrain.com. Some of these include:

  • Invoices, receipts and confirmation email to programs, events or courses you enrol in
  • i4 Assessment ‘rater invitations' sent by your colleagues, family or friends
  • i4 Assessment or Program invitations sent by third parties such as i4 Practitioners or an Organisation you work for.
  • Any system email related to the ownership of your account

When you are asked to be part of the i4 Neuroleader Assessment process and/or Programs, the invitations you receive are not unsolicited emails. They are triggered in our system by a person you may know. We send these emails on behalf of the initiator.

Please note that because these emails are not marketing or newsletter related, they do not have an 'unsubscribe' function available. If you wish to suppress receiving these emails please contact us directly and we will ensure that you never recevie any type of system related email.

However, if a colleague or your employer wishes to send you an invitation to complete an i4 Assessment, suppressing these emails will mean that you won't be receiving their invitations.

Newsletter:
The second type is our e-newsletter which you would have personally chosen to sign up to, when:

  • Creating an account by ticking the checkbox provided in the sign up page,
  • Downloading content offers through our landing pages and/or i4 Partner landing pages,
  • Or by signing up directly on our website.

If you don't want to receive this type of email update, you can unsubscribe at any time. There is a checkbox to opt out inside the dashboard in the 'settings' page. There is also an 'unsubscribe link' at the bottom of all our newsletter and marketing emails.

13. Cookie

To provide the best service possible on our website, About my Brain Institute utilises ‘cookies’. A cookie is a small text file that is stored on your computer for record-keeping purposes. A cookie does not identify you personally or collect any other information about you, it does however identify your computer.

This is how we utilise the different types of cookies on our website:

  • Strictly Necessary Cookies: These cookies (with the origin ‘.aboutmybrain.com’) are necessary for the website to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in or filling in forms. You can set your browser to block or alert you about these cookies, but some parts of the site may not work then.
  • Targeting Cookies: These cookies are set through our site by our advertising partners (Hubspot, Sumo, Google, Twitter & Facebook). They may be used by those companies to build a profile of your interests and show you relevant ads on other sites. They work by uniquely identifying your browser and device. If you do not allow these cookies, you will not experience our targeted advertising across different websites. This ‘opt-in’ is remembered until you clear your cookies or access the website from another device or browser.
  • Performance Cookies: These cookies allow us to count visits and traffic sources, so we can measure and improve the performance of our site. They help us know which pages are the most and least popular and see how visitors move around the site. All information these cookies collect is aggregated and therefore anonymous. If you do not allow these cookies, we will not know when you have visited our site. This ‘opt-in’ is remembered until you clear your cookies or access the website from another device or browser.

14. Credit Cards

As long as you're a Member or have an outstanding balance with us, you'll provide us with valid credit card information and authorize us to deduct the charges against the provided credit card. You will need to replace the information for any credit card that expires with information for a different valid credit card.

Anyone using a credit card represents and warrants that he or she is authorized to use that credit card, and that any and all charges may be billed to that credit card and won't be rejected. If, for some reason, we're unable to process your credit card order, we will contact you by email and suspend your account until your payment can be processed.

About my Brain Institute utilises the payment gateway component provided by PayPal Australia Pty Limited (ABN 93 111 195 389).

We do not store any credit card information online or offline at anytime. Your credit card details are encrypted and securely sent to PayPal Australia Pty Limited for processing.

15. Refund Policy & Cancellations

15.1. Public Events, Workshops & Programs

Cancellations by the Client:
Tickets purchased to any public events, workshops or programs are non-refundable. If you are unable to attend, the enrollment can be transferred to someone else or the credit can be used towards any future programs and/or products offered and listed on the the About my Brain Institute website. Note that tickets cannot be resold for commercial gain.

Cancellations by Us:
We reserve the right to cancel or change event dates, time, line up & venue. Only in this case, refunds will be considered if the About my Brain Institute does not offer an alternate event date.

15.2. In-House Programs & Keynote Engagements

Cancellations by the Client:
All services are non-refundable. If a workshop, program or keynote is postponed by the client, a written request must be made at least 15 days prior to the delivery date. The session will then be rescheduled at no extra charge, subject to our availability.

If canceled within 15 days of the delivery date, a re-booking fee of 50% of the total value of the session will apply.

Cancellations by Us:
We reserve the right to cancel or postpone services at anytime. In this case, a new date will be agreed with the client.

15.3. Coaching, Debriefs & On-Boarding Sessions

Cancellations by the Client:
All sessions are non-refundable. If there is a no-show or the session gets canceled by the client within 48 hours of the starting time of the session, a new booking fee of the same value will be charged if the client elects to re-schedule.

It is the client's responsibility to advise the coach if there are any delays in commencing the session. Please note: If the client is late, the session will be automatically canceled after 15 minutes of the starting time. A new session will then be re-scheduled at the client's cost.

If the cancellation occurs prior to the 48 hours from the starting time of the session, there will be no additional costs for re-scheduling. This cancellation must be made in writing via email prior to the 48 hours, to the appointed coach and also to support@aboutmybrain.com.

Cancellations by Us:
We reserve the right to cancel or postpone sessions at anytime. In this case, a new date will be agreed with the client at no additional charge.

15.4. Online Courses, Assessments & Other Products
All digital & physical products are non-refundable.

16. Invoicing & Payment Terms

Invoices that are issued upon confirmation of services are payable within the time frame stipulated on the invoice.

Invoices not paid by the due date, will carry a penalty of $50 per additional day. These additional charges will be invoiced separately once the original invoice has been paid.

If electing to make payment by Bank Transfer, it is the responsibility of the client to quote the invoice number when making the deposit and send a confirmation receipt so we can track your payment.

17. Filming & Photography Disclaimer

Patrons attending any events, programs and/or workshops consent that the About my Brain Institute and third parties authorised by About my Brain Institute may make or record film, photographs or other forms of moving picture of the event (including, without limitation, of patrons) for the use of media and promotions.

All patrons attending any events agree to the below stated terms and conditions. This event and any person attending may be filmed, photographed and/or recorded. By remaining in this area and by entering the event:

  • You acknowledge that you have been informed that you may be photographed and/or filmed and/or recorded and you give your irrevocable permission to be photographed and/or filmed and/or recorded.
  • You grant your irrevocable permission for your likeness, mannerisms and/or voice to be included in any content from such filming, photographs and /or recording (and edited) without compensation and/or credit, which content may be communicated and/or used in any and all media worldwide in all perpetuity.

18. Additional Terms

We are constantly innovating and trying to improve our platform and services. That includes rolling out new features, functionality and updating our pricing. This may involve new ways in which we process your data and/or price our services that may require us to modify or supplement our existing Terms of Use.

19. Accepting this Agreement

By signing up for an account with the About my Brain Institute, using and/or purchasing our products and services, you are agreeing to the terms stipulated on this page.
